Los sábados suelen ser días de descanso y relax para las personas. Sin embargo, los emprendedores consagrados y los empresarios saben que los sábados también pueden ser días propicios para planificar y preparar el camino para lo que viene, especialmente cuando desean poner su carrera o su negocio en otro nivel. Desde el punto de vista de la inmigración para/por negocios o “business inmigration” la planeación es fundamental. Sin embargo, no hablo de resolverlo todo el sábado, o de tener todas las respuesta en un día, especialmente en el día en el que estas tratando de recargar tus baterias para iniciar una nueva semana. Sin embargo, como parte de este proceso puedes dar pasos importantes un sábado! El día de hoy de voy a hablar de uno fundamental, Paso 1: Determinar qué es lo que deseas.
¿Tienes claro que deseas?
Muchas personas hablan de venir a los Estados Unidos. Sin embargo, dicha frase por sí sola no dice nada acerca de lo que realmente quieres. A fin de elegir una visa, planer cambios de estatus, viajar, salir y entrar multiples veces de los Estados Unidos, saber que deseas es fundamental. Ahora, la pregunta va enfocada a cuáles son tus planes a corto, mediano y largo plazo teniendo en cuenta al menos:
¿Dónde deseas establecer tu residencia?
Unos de los aspectos más importantes para escojer una visa o hacer un plan de inmigración es entender dónde deseas establecer tu residencia, vivir con ánimo de permanencia. Si deseas vivir en los Estados Unidos, probablemente las visas L, E o EB pueden ser una opción viable. Sin embargo, si no deseas vivir en los Estados Unidos, por ejemplo, porque deseas viajar constantemente por asuntos de negocios quizas la visa B, o E-2, especificamente, pueden ser mejor. Es fundamental saber donde deseas vivir porque una vez iniciado un proceso migratorio, sea para una visa o para solictar la residencia, es posible que tus posibilidades de cambiar de residencia sean limitadas, y si no tienes claros tus planes el estres o tu estado emocional pueden ser un factor negativo.
¿Quieres trabajar en de los Estados Unidos?
Muchas personas están enfocadas en cumplir un propósito en los Estados Unidos y después de cumplido, salir, por ello, para estas personas no están especialmente enfocadas en poder trabajar en los Estados Unidos. Otras personas, desean estar en los Estados Unidos para quedarse por una temporada un tanto larga y trabajar o tener un ingreso es fundamental. Dependiendo de ello, es posible que ciertas visas como la visa F, de estudiante, no sea la mejor opción.
¿Quieres/Necesitas viajar constantemente a tu país de residencia original?
Como ya lo he mencionado, salir de los Estados Unidos una vez que se inicia un proceso, por ejemplo, de ajuste de estatus para obtener la “green card” o cambio de estatus para aplicar a una visa de inversionista, las posibilidades de viajar pueden verse limitadas, entre otros, porque adquirir un permiso de salida y entrada puede tomar hasta 6 meses, los tiempos de procesamiento de las visas y los protocolos cambian de un país a otros, etc. Así, es fundamental que hagas tus planes y tengas claro si necesitaras o no viajar a tu país. Normalmente, un proceso de cambio de estatus o de residencia puede tomar 6 a 12 meses, salvo en los casos de visas empresariales que pueden beneficiarse del “Premium processing”.
¿Tienes claro como deseas manejar tus asuntos tributarios?
Muchas personas no desean obtener la “green card”, aun cuando quieren tener la posibilidad de viajar constantemente a los Estados Unidos y permanecer por largos periodos. Pues bien, uno de los aspectos más importantes de solicitar y obtener la residencia en los Estados Unidos, y eventualmente la ciudadanía, es que estas obligado a reportar tus activos y tus ingresos en el exterior. Esta obligación no es igual para otros beneficarios de visas, quienes no tiene la calidad ni de residentes ni de ciudadanos. Por todo lo anterior, es importante pensar en el tema de los impuestos antes de apresurarse a solicitar un determinado estatus o visado.

Naturalization
